Escape Xperience — also trading as Magische Speurtochten and the associated games, including Drakenjacht.
Article 1 — Definitions
- Operator: Escape Xperience, a sole proprietorship established in Amersfoort, registered with the Dutch Chamber of Commerce under number 87185229, also trading as Magische Speurtochten and the associated games, including Drakenjacht (and future games such as Eenhoornjacht, Dinojacht, Kabouterjacht and Elfjesjacht).
- Customer / consumer: the natural person who is not acting in the course of a profession or business and who makes a booking.
- Game: an interactive trail played on a smartphone via the Loquiz app in a designated park or area.
- Team: a group of participants who play the game together using one phone. One ticket is required per team.
- Login details / ticket: the digital access details (username and password) provided for each team and used to start the game in the Loquiz app.
- Loquiz: the third party (Loquiz OÜ) that provides the game platform and app.
- Agreement: the booking of one or more tickets for a game via the website.

Article 3 — Applicability
These terms and conditions apply to every offer made by the operator and to every agreement concluded between the operator and the customer. Before the agreement is concluded, the text of these terms and conditions will be made available to the customer electronically in a way that allows the customer to save and retain them.
Article 4 — Offer and prices
The offer and the games are described on the website. Obvious mistakes or errors in the offer are not binding on the operator.
The price is per team, includes 21% VAT and is stated in euros. The price displayed on the website at the time of booking applies. The current price for Drakenjacht is €9,95 per team.
Article 5 — Formation of the agreement
The agreement is concluded when the customer completes the booking form on the website in full, places the order and successfully completes payment. The customer will then receive electronic confirmation containing the login details for each team.
Article 6 — Payment
Payment is made through the Mollie payment service (including iDEAL and credit card). The full price must be paid in advance. The login details are only created and supplied once payment has been received.
Article 7 — Delivery and validity
Once payment has been received, login details are created immediately for each team and sent to the customer by email. The customer is responsible for providing a correct email address and for being able to receive this email (please check the spam/junk folder if necessary).
The login details can be used for three (3) months after the booking. The customer may choose when to play the game within this period; no fixed date needs to be selected. After this period, the login details expire and can no longer be used.
Article 8 — What you need to play
To play the game, each team needs:
- a smartphone with an internet connection (one phone per team);
- the free Loquiz app (available from the App Store or Google Play);
- a sufficiently charged phone.
Any mobile data charges are the customer’s responsibility. The operator is not responsible for the operation of the customer’s phone, operating system, app stores or internet connection.
Article 9 — Cooling-off period and right of withdrawal
The customer has a 14-day cooling-off period after booking. During this period, the customer may withdraw from the purchase and request a refund, provided that the login details have not yet been used — in other words, provided that no team has started the game.
Once the login details have been used (the game has been started), or once the 14-day cooling-off period has expired, the right of withdrawal ends and a refund is no longer possible. Because the login details are supplied immediately after booking, we draw the customer’s attention to this during the booking process.
To exercise the right of withdrawal, send an email to info@escape-xperience.nl within the applicable period. Following a valid withdrawal, the operator will refund the full amount as soon as possible and no later than 14 days afterwards, using the same payment method as the original payment.
Article 10 — Changes and cancellations
Except in the circumstances described in Article 9, cancellation is not possible after delivery. No fixed playing date is booked; within the three-month validity period, the customer chooses a suitable time and location.
Article 11 — Technical faults and force majeure
The operator will make every reasonable effort to ensure that the game runs properly. If an unexpected technical fault occurs, or in the event of force majeure, the operator will assess the situation together with the customer and will always seek an appropriate solution. This may include replacement login details, extending the validity period or — if a solution genuinely is not possible — agreeing a full or partial refund.
Force majeure means any circumstance beyond the operator’s will and control that temporarily or permanently prevents performance, including outages affecting Loquiz, the app stores, internet or electricity services, and extreme weather conditions.
Article 12 — Safety, supervision and use
The game is played outdoors, in public spaces and parks. Participation is at your own risk. The accompanying adult is responsible at all times for the safety and supervision of participating children, for observing traffic rules and for complying with local rules (for example, park rules). The customer must ensure that participants behave responsibly and safely and show consideration for their surroundings and other visitors.
Article 13 — Liability
The operator is not liable for damage arising during or as a result of participation in the game, except in cases of intent or deliberate recklessness on the part of the operator. In particular, the operator is not liable for damage resulting from faults in the Loquiz app, the app stores, the customer’s phone, operating system or internet connection.
Where the operator is nevertheless liable, that liability is limited to no more than the amount paid by the customer for the booking concerned. Liability for indirect loss (including consequential loss and lost savings) is excluded. The limitations in this article do not apply where and to the extent that mandatory law provides otherwise.
Article 14 — Intellectual property
All intellectual property rights relating to the games, content, texts, images, logos and design belong to the operator or its licensors. The login details are personal and intended solely for the customer’s own booking; they may not be resold or distributed commercially.
Article 15 — Personal data
The operator processes personal data in accordance with the privacy policy available on the website.
Article 16 — Complaints
Complaints about the performance of the agreement may be submitted to the operator within a reasonable period, with a full and clear description, by emailing info@escape-xperience.nl. The operator will respond within 14 days of receiving the complaint. If more time is required to deal with the complaint, the operator will inform the customer within that period.
Article 17 — Governing law and disputes
The agreement is governed exclusively by Dutch law. Disputes will be submitted to the competent court, unless mandatory law requires a different court to have jurisdiction.
Consumers within the EU may also submit a dispute via the European Commission’s ODR platform: ec.europa.eu/consumers/odr.
Article 18 — Changes to these terms
The operator may amend these terms and conditions. Each booking is governed by the version that applied at the time the agreement was concluded.
